Tribunal Acquits Tinubu; Blasts FG For Not Complying With The Law  print

A three-man panel of the Code of Conduct Tribunal led by Mr. Danladi Yakubu Umar has dismissed the three-count charge brought against former Governor of Lagos State, Asiwaju Bola Ahmed Tinubu.

Tinubu was alleged to have operated and maintained several foreign accounts while in office as the Governor of Lagos State contrary to the provisions of the Code of Conduct Bureau and Tribunal Act.

In its ruling this morning, the tribunal maintained that the charge did not comply with the provisions of the Act which demands that an accused person should be invited and confronted with allegations against him or her for an opportunity for such an accused person to make a written admission or denial of the allegations before the matter can be transferred to the tribunal for adjudication.

In the course of the trial, the former Lagos State governor had complained to the tribunal that he was neither invited nor summoned by the Code of Conduct Bureau as it did to other governors, to come and make a written admission or denial of the allegations against him.

In agreeing with the former governor, the tribunal held that the provisions of Section 3(d) of the Act is a condition precedent which must be complied with before the tribunal will become vested with jurisdiction to try an accused person.

The tribunal blasted the Federal Government for flouting the provision which the lawmakers inserted in the Act with the intention to avoid overcrowding the tribunal with cases which would have been resolved upon the invitation of an accused person by the Code of Conduct Bureau.

He dismissed the submissions of the Federal Government that it invited Tinubu severally to the bureau without success and noted that there is no evidence before the tribunal to support the claims that Tinubu was ever invited by the Code of Conduct Bureau to make a written admission or denial of the allegations against him before he was dragged to the tribunal.

Furthermore, the tribunal held that the leave he granted to the Federal Government to commence the trial of Tinubu was in relation to an earlier one-count charge filed before the tribunal and not for the three-count charge upon which the trial commenced. It held that it was an abuse of court process having discontinued with the one-count charge.

It also held that there was no summary proof of evidence attached to the amended three-count charge upon which Tinubu is standing trial.

Consequently, the tribunal quashed the charges brought against the former Lagos State governor and dismissed them.

Tinubu was arraigned before the tribunal on 21 September over allegations of operating foreign accounts while in office as Lagos State governor.

His counsel made up of 10 Senior Advocates of Nigeria and 21 other lawyers objected the efforts of the prosecution led by Mr. Alex Izinyon, SAN, to substitute the one-count charge with a fresh three-count charge.

Addressing reporters after the sitting, Tinubu described his case as political persecution and challenged his accusers to bring proof of his foreign accounts, if they had any.

    Jagaban! … The Asiwaju of the whole universe. Ride on … the more they come; the more they fall. This is a test of your integrity (which many have questioned ignorantly). Tinubu had won court cases (personally and collectively) more than any single Nigerian in the last 12 years (i stand to be corrected). I congratulate him for this additional victory which had laid credence to the fact that he who God created, no man can destroy.
    I read Olabode George’s interview recently where he advised Tinubu to be prepared for jail …. hmmmmm, thank God Bode George is alive to witness this day … hip, hip, hip!!!

PDP is a nest of robbers, still they have not been successful in bringing any of theirs into books despite overwhelming evidences. Tinubu is just an hardnut for them to crack.     What a shoddy job FG has done. This call to questioning the competency of those vested with the responsibility of tidying up nay issue before bring same to law court. on the other hand, this goes to say that this case i s politically motivated, i wonder what some people stand to gain in bringing down others because of their selfish interest. Thank GOD that the judge is honest enough not to do the bidding of some disgruntled elements.

    The substantive case is still legit. It’s only defeated on technical grounds. It doesn’t mean Tinubu did not commit the crime.

    It is clear here that the so called FG is in a total mess. The more overzealous they may act to fight their oppenents the more trouble they will cast for themselves. What of their own that is stealing Benue money with a stolen mandate and a forged GCE? Three GCE certificate with one number and different scores, different subjects. Granted Suswam was of anyother political party, certainly he would have been cooling his heels somewhere at the back of Funtaj International junior and senior high school, Kuje (Kuje prisons) where he wouldnt have access to Dooshima his wife for years. No wonder many of his commissioners are holders of fake degrees. How do u blame the youths of the state and others?

A state governor with 1 authentic GCE certificate and 2 forged ones all bearing the same number, the same name but different scores. If this man was a member of anyother political party, he should have been cooling his heels somewhere in Kuje, Abuja or Kirikiri Lagos. Tinubu, you are our man! You are invited to Benue state to celebrate Prof. Ugba as the substantive governor of the state soonest. The man there with the stolen mandate will soon go to jail.

    Now the ICPC should go and follow due process. Little wonder that Mr. President is overhauling both the ICPC and EFCC. This judgment is based on technicalities, and not on substance. The case will definitely be reopened. My President should also visit his new found toughness on the NDLEA.
