A Lagos businessman, Alhaji Adesoji Ahmed Durosinmi, has been dragged before an Apapa Chief Magistrate’s Court for allegedly owing his business partner, Mr. Atoba Ola Esan, N100,000, who also petitioned the police over a dud cheque issued to him.
In his claim, Esan averred that sometimes in October, 2008, Alhaji Adesoji Ahmed Durosinmi contacted him construct an aluminum roofing of Odogunyan Junior Secondary School, Ikorodu, Lagos State, a contract for which was awarded to him by the Lagos State government under the Lagos State Schools Rehabilitation Project.
The agreed sum for the contract was N1,150,000, but only N750,000 was paid to Esan after the execution and delivery of the job in January, 2009, leaving an outstanding sum of N400,000.
Alhaji Durosinmi was alleged to have issued a cheque for the outstanding sum of N400,000 but was dishonoured on the basis of his account not being funded.
Thereafter, the law firm of Olawale Balogun was instructed to write a petition to the Commissioner of Police, Lagos, over the issuance of the dud cheque.
The defendant admitted issuing the cheque, but pleaded not to be prosecuted for the offence, while he undertook to pay the outstanding sum.
However, the defendant paid only N300,000 in three installments leaving an outstanding indebtedness of N100,000 which he has refused to pay up till date.
The plaintiff is now claiming the sum of N100,000 plus interest of N36,417 and N50,000 being the cost of this legal action.
