Court Dismisses Workers’ Suit
The Federal High Court sitting in Alausa, Ikeja, Lagos, Nigeria, has dismissed a suit filed by some workers of a Lagos-based plastic manufacturing company, CELPLAST Industries Nigeria Limited, seeking the enforcement of their fundamental human rights.
Five of the dehumanised workers had taken the company to court, accusing it of being responsible for their plight and demanding compensation.
But delivering judgement in the matter, the judge, Justice Stephen Adah, said the matter should not have been brought under enforcement of fundamental human rights because the issues had to do with employer and employee relationship.
“This instant case no doubt is a case dealing with employment and workers compensation which are class action specified under the Worksman Compensation Act. This cannot be brought under fundamental human right. The objection of the respondent is hereby upheld,†he stated.
Justice Adah described the application as incompetent and struck it out.
After the judgement, the workers vowed to continue their protest against the company.
