IT Company, Others Face Criminal Charges
A Federal High Court sitting in Lagos, South West Nigeria, has adjourned for trial, the criminal charges of copyright infringement of Microsoft materials preferred against a limited liability company, Heritage System Technologies and three others, Azubuike Mbanugo, Jimmy Z hang and Q-link IT Centre.
According to a criminal charge number FHC/L/226c/10 filed before the court by the Nigerian Copyright Commission’s prosecuting counsel, Mr. D.T Najime, it was alleged that Heritage System Technologies, Azubuike Mbanugo, Jimmy Zhang and Q-Link IT Centre, all of 14, Simbiat Abiola Street, Ikeja, on 27 April, 2006, did sell for the purpose of trade or business, two infringing copies of computer systems loaded with Microsoft Window XP copies in which copyright subsists in favour of Microsoft Nigeria Limited, without consent or authorisation of the copyright owner, thereby committed an offence punishable under Section 20 (2) (a ) of the Copyright Act Law of the Federation, 2005.
Mr. Najite further alleged that all the accused, at the same time and place, distributed the above mentioned infringed product which were find in their possession.
