Justice Ayo Isa Salami today formally withdrew his suit against the Chief Justice of Nigeria; Justice Katsina â€“ Alu and the National Judicial Council over attempts to elevate him to the Supreme Court bench.
Justice Salami told the court that he is withdrawing the suit because of the intervention of well meaning and eminent Nigerians who persuaded him to withdraw the suit in view of the controversy which his elevation to the apex court bench has generated in the polity.
He further told the court that the suit has become an academic exercise since the National Judicial Council had rescinded its decision to give effect to the purported recommendation for him to be elevated to the Supreme Court.
While throwing out the suit, Justice Adamu Bello threatened to terminate a similar action filed before him by Mr. Femi Falana, a Lagos based human rights lawyer, should he fail to withdraw same before March 14.
In his Notice of Discontinuance, Salami averred that â€œFollowing the intervention of well meaning Nigerians and stakeholders in the justice sector, I hereby apply to discontinue this suitâ€.
It would be recalled that Justice Salami, on February 8, dragged the CJN, the National Judicial Council, NJC, the Federal Judicial Service Commission, FJSC, as well as the Attorney General of Federation, AGF, before the federal high court.
In an affidavit in support of his suit, Salami averred that â€œI have all along enjoyed my work as President of the Court of Appeal and did not have any issues or disagreement with Katsina- Alu, until the controversies over the gubernatorial election petition in Sokoto state came to light.
