Family In Court Over Property
A prominent family in Kano, Barma, is now in crisis as one of the directors of the family’s company, Alhaji Kano Amadu Shuaibu Ahmed Barma, has engaged other family members in a legal battle over a parcel of land at Plot 20, Block M, along Oshodi-Apapa Expressway, Ilasamaja, Lagos State.
On the other side of the legal hostility as defendants are Alhaji Kadiri Abdul Barma, Alhaji Suleiman Barma, Alhaji Sanusi Barma, Alhaja Fatimah Barma, Alhaja Sallah Barma, Alhaja Adisa Barma and Alhaji Kano Shuibu Aminu Barma, representing themselves and other members of the Barma family.
Alhaji Shuaibu Ahmed Barma, alongside the family’s company, AGS Barma Limited, who are plaintiffs in this suit, are urging the court to restrain the defendants from selling the company’s property.
In an affidavit sworn to by Alhaji Kano Amadu Barma and filed before a Federal High Court in Lagos by Barrister Paul Ogedegbe, the deponent averred that AGS Barma is still a going concern and as such, the defendants cannot validly sell any of its properties without due process of the law as any of such sales shall be invalid, illegal, null and void.
He averred further that it came to his notice and knowledge that some of the directors, who are defendants in this suit, are planning, without following due process, to sell the company’s properties at Plot 20, Block M, Oshodi-Apapa Expressway, Ilasamaja, Lagos State, contrary to the provision of the Companies and Allied Matters Act, 1990.
Alhaji Ahmed Barma also averred that the defendants, being the descendants of the same parents, are working on the false belief that after the death of their biological father, Alhaji S.A. Barma, who was then the chairman of AGS Barma, the property is a family property that is subject to jurisdiction of Sharia law and as such, they are now hiding under the jurisdiction of the Sharia Court in Gadi, Kano, to sell the company’s property.
However, the property, he averred, belongs to the company and it is registered under the Companies and Allied Matters Act 1990 and in the Land Registry, Alausa, Ikeja, Lagos State and as such, a Sharia Court holden in Gyadi, Kano State, has no jurisdiction and therefore prayed the court to order the Sharia Court of Kano State to stay proceedings in the plan to sell the company’s property as it is incorporated under CAMA, 1990.
