Surety To Forfeit N150,000
A man, Owolabi Tomiwa is to forfeit the N150,000 he paid to stand as surety for an accused granted bail on charges of theft.
The surety was alleged to have on 13 January, 2011 paid the money as part of the conditions for the accused, Nurudeen Afolabi, to be granted temporary freedom but failed to produce the accused when required by the police.
His offence is contrary to Section 132 (1) of the Criminal Justice Laws of Lagos State.
The charge reads:†Owolabi Tomiwa on 113 January, 2011 at the X-Squad Office, Ikeja,Lagos in the Lagos Magisterial District did enter into recognisance in the sum of one hundred and fifty thousand naira (N150,000) only subject to the condition that you will produce one Nurudeen Afolabi, an accused in a case of stealing at the above office on 20 January, 2011 and any other subsequent date, until the case is finally disposed off.
“Whereas on 20 January at the said office you did fail to produce the said Nurudeen Afolabi to the police to be charged to court.
“You are thereby required to show cause why you should not forfeit to the state the sum of one hundred and fifty thousand naira (N150,000) entered into by you in the recognisance under Section 132 (1) of the administration of Criminal Justice Laws of Lags State, 2003.â€
