Court strikes out case against Jim Iyke

Nollywood actor, JIim Iyke got a reprieve from an Abuja Chief Magistrate Court on Tuesday as a fraud charge bordering on criminal misappropriation brought against him by the Nigeria Police was struck out by the court.

Chief Magistrate Azubuike Okeagu struck out the charge following the decision of Iyke and the complainant, Ms. Habiba Abubakar to resolve their differences through an amicable out of court settlement.

Earlier, the police had filed a First Information Report, FIRS, before the court seeking to establish a prima facie case against Iyke but at the same time failed to support the allegation with proof of evidence.

Sequel to a letter by the complainant, Abubakar asking that the charges be withdrawn the court had no option than to strike out the case.

The police prosecuting counsel, Mr. Danjuma Etobi, informed the court that he was instructed by his superiors to apply for the withdrawal of the matter.

“I have been directed to withdraw this case. Therefore I apply under Section 130 of the Criminal Procedure Code owing to the circumstances and instructions of my superiors to terminate the case CR No 366/2011 which was brought before this court on November 10, 2011.”

Iyke’s counsel, Ms. Esther Uzoma, told the court that she had no objection to the termination of the case and the Chief Magistrate subsequently struck out the matter.

The Nollywood actor was alleged to have committed a criminal act over a shares transfer transaction.
