Nnamdi Felix / Abuja
The National Secretary of the Peoples Democratic Party, PDP, and former governor of Osun state, south west Nigeria, Mr. Olagunsoye Oyinlola on Wednesday dragged the National judicial Council, NJC, before a Federal High Court sitting in Abuja over the council’s decision to reinstate suspended president of the court of appeal Justice Ayo Isa Salami.
The court presided by Justice Abdul Kafarati however adjourned to 24th January to decide whether or not the former governor could proceed with the suit.
Oyinlola, who was called to the Nigerian bar last week, wants the court to set aside a pending recommendations made to the President by the NJC for the reinstatement of Justice Salami.
He contended that the recommendation is a nullity on ground that Justice Salami still has a pending case in court challenging his removal.
The former governor also wants the court to make an order of perpetual injunction restraining President Jonathan from acting upon the NJC’s recommendations.
The NJC however opposed the suit which it said is frivolous.
Similar position was adopted by President Jonathan and the Attorney General of the Federation and Minister of Justice, Mohammed Bello Adoke, both of whom urged the court to dismiss Oyinlola’s suit and the reliefs being sought in its entirety.
