PDP Crisis: Court Declines Tukur’s Bid To Stop Baraje

Embattled national chairman of the crisis ridden Peoples Democratic Party, PDP, on Friday approached a Federal High Court siting in Abuja asking the court to stop the members of the Abubakar Baraje led breakaway faction of the party from parading themselves as national executives of the PDP.

The Bamanga Tukur led faction of the Party in a case filed on its behalf by Chief Tochukwu Onwubufor, a senior advocate of Nigeria, urged the court to restrain Baraje and other executive members of the break away faction from parading themselves as the national executives of the party.

Joined as respondents alongside Baraje are the Independent National Electoral Commission, INEC, Sam Jaja, Olagunsoye Oyinlola and Atiku Abubakar.

Tukur’ks application to stop Baraje and others from parading themselves as the executives of the party was brought before the court through ex-parte (without notice).

However, Justice Elvis Chukwu, refused to grant the application and ordered Bamanga Tukur to put Baraje and the other defendants on notice.

The court further ordered that the executives of the breakaway faction be served through substituted means.

“Although I am not afraid of granting an ex parte application especially when it is obvious of causing anarchy, however, I owe a duty to maintain a balance. What I want to do is order that the respondents be put on notice.” Justice Chukwu stated

The court also ordered that parties should maintain status quo ante bellum pending the determination of the suit and consequently fixed 12th September for the hearing of the motion on notice.
