Andy Uba: Court to listen to parties Wednesday

Justice H.A Nganjiwa of the Nigerian Federal High Court in Port-harcourt will tomorrow 11 September hear a motion for interlocutory injunction seeking to restrain the PDP and INEC from recognizing any other person other than Senator Andy Uba as candidate of the party for the governorship election in Anambra state.
The election will hold 16 November.
The Ejike Oguebego led Anambra State PDP which is recognized by INEC had gone to court to challenge the decision of the National Working Committee of the PDP to recognize the Ken Emeakayi faction of the Anambra PDP which produced Tony Nwoye as candidate.
The court rejected move by the PDP that its motion challenging the powers of the court to entertain the matter should be heard first before the motion for interlocutory injunction.
Counsel to the Uba’s faction of the PDP Jude Nnodum said that they want the PDP and INEC to accept the outcome of the primary election which produced Andy Uba as candidate pending the determination of the substantive suit.
Counsel to the PDP, Mmecha Kalu argued that when the powers of a court is being challenged in a matter, the court ought to determine its jurisdiction first before proceeding.
