Illegal Detention: Appeal Court fixes 5 Nov for case against IGP

The Court of Appeal, sitting in Benin, has fixed 5 November, 2015, for hearing of a case of non-compliance with a judgement it gave on 6 May, 2013, ordering the former Inspector-General of Police to pay the judgement sum of N5 million to ‎Rev. David Ugolor for illegally detaining him.

In the suit with No. CA/B/360/2012, between the Inspector-General of Police, Nigerian Police Force, the Attorney-General of the federation (Appellants/Respondents) an‎d Rev. David Ugolor (Respondent/Applicant), Counsel to Rev. Ugolor, Barrister Emmanuel Afolabi, had prayed the Court to make “an order of the Court directing the Appellants/Respondents to obey the order it made on the 6th day of May, 2013, directing the Appellant/Respondents‎ to pay the judgement sum of N5, 000,000.00 (Five Million Naira) to thr Deputy Chief Registrar of this Court who shall immediately deposit same into an interest-yielding account to abide the outcome of the appeal filled by the Appellants/Respondents.”

According to Barrister Afolabi, the grounds upon which the application was founded were:

“The appellants have failed to obey the order of this court directing the Appellants to pay the judgement sum of this court who shall immediately deposit same into an interest-yielding account‎.

“The order made on the 6th day of May, 2013 has not been obeyed till date, whereas the order has not been set aside by the appellate court.

“The conduct of the appellants/respondents shows that the appellants/respondents have no respect for the lawful order made by the court.”

The Presiding Judge, Hon. Justice P.M. Ekpe, supported by Hon. Justice H.A. Barka and Hon. Justice U.A. Ogakwu, thereafter fixed hearing in the case for 5 November, 2015.

P.M. NEWS recalls that the appellate court had awarded the judgement sum of N5 million against the Applicants/Respondents for allegedly detaining Rev. David Ugolor illegally over the murder of Comrade Oliatan Oyerinde, the late Principal Private Secretary to Governor Adams Oshiomhole, on 3 May, 2012.
