The expelled Minority Leader of the Rivers State House of Assembly, Benibo Frederick Anabraba, has instituted a suit against the All Progressives Congress (APC) challenging his expulsion from the party by the State Working Committee (SWC) of the party.

Anabraba who is also a lawyer and representing Akuku-Toru 2 Constituency was expelled for anti-party activities through a letter by the party’s SWC, dated January 27, 2017, and signed by the state chairman, Dr. Davies Ibiamu Ikanya.

Anabraba’s trouble started when he disobeyed the party’s caucus arrangement that Josiah Olu, also of the APC representing Eleme Constituency be nominated and elected as Minority Leader of the House.

But against the wish of the APC, Anabraba was nominated by PDP lawmakers who voted for him as Minority Leader.

The defendants in the suit are the All Progressives Congress (1st defendant), Davies Ibani Ikanya, State APC Chairman, (2nd defendant), Hon John Josiah Olu, (3rd defendant), Speaker, Rivers State House of Assembly, (4th defendant) and the Rivers State House of Assembly (5th defendant).

In his originating summon, Anabraba is praying the court to determine among other things; “whether having regards to the provisions of sections 95(1), 96 (1) 98(1) and (2) and 101 of the 1999 Constitution as amended and Order 10(1) of the Standing Orders of the Rivers State House of Assembly, 1999, the Plaintiff’s election as the Minority Leader of the 5th defendant is constitutional and legally valid.

No date has been fixed for the hearing of the case.
