A Customary Court Grade C situated at Inalende Area of Ibadan, capital of Oyo State, has dissolved a four-year old marriage between Mr. Omoniyi Ayeni and his wife, Temilade Omolayo.

An Ibadan Customary Court (Grade C) situated at Inalende Area of Ibadan, capital of Oyo State, has dissolved a four-year old marriage between Mr. Omoniyi Ayeni and his wife, Temilade Omolayo.

In his judgment, the President of the court, Elder Olafenwa Ramoni dissolved the marriage which produced a child because of lack of love.

The petitioner (husband) had alleged that his wife wanted to kill him and the children of his senior wife.

Elder Ramoni said, “With the overwhelming evidence against the respondent, it is crystal clear that there is no love between the couple again, hence, this court dissolves the marriage. We want you to pay N3,000 monthly for the upkeep of your child in care of your ex-wife.”

Responding, the overjoyed petitioner told the court that he was pleased with the judgment to the extent that if the court had asked him to pay N5,000 for the upkeep of the child, he would not mind. As a result, the court reviewed the judgment and asked the petitioner to pay N5,000 monthly to the respondent for the upkeep of the only child of the dissolved marriage.

The petitioner had stated in his divorce-petition: “Since I married her, I have never had peace of mind. She fights me everyday. Anytime she attempts to kill me, I will run away by jumping out of the compound through the fence. Several times, she attempted to kill my children that the senior wife had for me. At times, she would add large quantity of salt to their food. She even soak their clothes in chemical. My family does not want us to continue to live together again because they are scared that one day, she will kill me and my children. Despite the fact that I rented an apartment for her somewhere, she will come to my shop to foment trouble. She fights my customers and she has driven them away”.

He described his estranged wife further as a flirt and very stubborn. ”She will leave the house for about five days without telling me where she has gone. If I ask her where she was coming from, she would begin trouble”.

Responding, the wife urged the court not to dissolve the marriage, saying, “no one can dissolve my marriage with my husband. Any one that will dissolve this marriage will kill me first. After being killed, I will come back to take my husband because I really love him.”
