A Tinubu Magistrate’s Court, Lagos Island, Lagos, south west Nigeria has struck out a case of alleged assault instituted against a businessman, Olugbenga Yakubu, Following a request for the withdrawal of the case by the police at Ajah Division, Ajah, Lagos.
Yakubu was charged before the Tinubu Magistrate Court on July, 2016 in charge No: C/128/2016 on a two-count charge of unlawful assault on Emen Eni Asuquo.
He allegedly damaged his Toyota Carina E car front and rear glasses valued at N75,000.
When the matter came up for hearing on 25 February, 2018 the police prosecutor, Inspector Philip Osijale presented an application of withdrawal from the Divisional police officer, DPO in charge of Ajah Division Ajah, Lagos to the presiding Magistrate, L. O. Kazeem directing him to withdraw the assault case since the parties have resolved the matter.
In his ruling, Magistrate Kazeem said: ”In view of the application of withdrawal dated 25 February, 2018 and duly signed by the police in a case of alleged assault they instituted at the Tinubu Magistrate’s Court, Lagos, the matter is hereby struck out as prayed by the police.
