A 27-year-old tailor, Toheeb Rasaq, who allegedly punched his landlord and hit him with a chair, on Wednesday appeared before an Ikeja Magistrates’ Court in Lagos.
The defendant, who resides in Olateju, Mushin, Lagos, is facing a three-count charge of breach of peace, assault and causing grievous harm, to which he pleaded not guilty.
The Prosecutor, Insp. Aondohemba Koti, told the court that the defendant committed the offences on Nov. 4, 2018 at his residence.
He said that the defendant conducted himself in a manner likely to cause breach of peace by assaulting the complainant, Mr Theophilus Afolayan.
“The defendant assaulted the complainant with a chair which caused grievous harm to his left eye.”
Koti said that the complainant tried to settle a fight that ensued between the defendant and his wives.
“The defendant tuned to the complainant and punched him several times on the face.
“He was not satisfied with the punches, he then used a chair and hit him on his on his eye, ” the prosecutor said.
The offences violate Sections 168, 173 and 245 of the Criminal Law of Lagos State, 2015.
The News Agency of Nigeria (NAN) reports that Section 173 prescribes three years imprisonment for assault while section 245 stipulates seven years for causing grievous harm.
In her ruling, the Magistrate, Mrs M.O Tanimola, granted the defendant bail in the sum of N80,000 with two sureties in like sum.
Tanimola said that the sureties should be gainfully employed and should show evidence of two years tax payment to the Lagos State Government.
She adjourned the case until Feb. 18, for mention.
