That you CX FLEET 1, EMEKA CHIDIEBERE, OKORIE COLLINS CHUKWUMA, KINGSLEY TAMUMOBELEMA IBIABUO, IYOBASOGIGIE VICTOR AND AJENU MICHEAL on the 3rd day of February 2020 in Lagos within the jurisdiction of this Honourable Court, without appropriate licence stored 100 Metric Tonnes of Automotive Gas Oil (AGO) in MV CX FLEET 1 and thereby committed an offence contrary to Section 4 of the Petroleum Act, Cap P10, Laws of the Federation of Nigeria, 2004.

A Federal high court Judge, Justice Tijani Ringim sitting in Lagos south west Nigeria has adjourned till 1st of December 2022, for continuation, the trial of a Vessel MV CX FLEET 1 and five of its crew members alleged to have conspired together without a licence to deal in and stored 100 Metric tonnes of Automotive Gas Oil, thereby committed an offence contrary to and punishable under Petroleum Act.

The amended charges as filed before the court by the Economic and Financial Crimes Commission (EFCC)’s prosecutor, Barrister Rotimi Oyedepo are as follows:

COUNT 1: That you MV CX FLEET 1, EMEKA CHIDIEBERE, OKORIE COLLINS, CHUKWUMA, KINGSLEY TAMUMOBELEMA IBIABUO, IYOBASOGIE VICTOR and AJENU MICHEAL on the 3rd day of February 2020 in Lagos within the jurisdiction of this Honourable court, conspired amongst yourselves to commit an offence to wit: dealing in 100 Metric Tones of Automotive Gas Oil (AGO) without appropriate licence and thereby committed an offence contrary to section 3(6) of the Miscellaneous Act, Cap M17, Laws of the Federation of Nigeria, 2004 and Punishable under section 1(17) of the same Act

COUNT 2: That you MV CX FLEET 1, EMEKA CHIDIEBERE, OKORIE COLLINS CHUKWUMA, KINGSLEY TAMUMOELEMA IBIABUO, IYOBASOGIE VICTOR and AJENU MICHEAL on the 3rd day of February 2020 in Lagos within the jurisdiction of this Honourable Court, without appropriate licence dealt with 100 Metric tonnes of Automotive Gas Oil (AGO) thereby committed an offence contrary to and punishable under section 1(17) of the Miscellaneous Offences Act, Cap M17, Laws of Federation of Nigeria,2004.

COUNT 3: That you CX FLEET 1, EMEKA CHIDIEBERE, OKORIE COLLINS CHUKWUMA, KINGSLEY TAMUMOBELEMA IBIABUO, IYOBASOGIGIE VICTOR AND AJENU MICHEAL on the 3rd day of February 2020 in Lagos within the jurisdiction of this Honourable Court, without appropriate licence stored 100 Metric Tonnes of Automotive Gas Oil (AGO) in MV CX FLEET 1 and thereby committed an offence contrary to Section 4 of the Petroleum Act, Cap P10, Laws of the Federation of Nigeria, 2004.
