Tribunal Dismisses NCP Petition Against Uduaghan
The Governorship Election Petition Tribunal in Delta has dismissed the petition filed by the National Conscience Party (NCP) candidate, Mr Collins Eselemo challenging the election of Governor. Emmanuel Uduaghan of the PDP.
The tribunal in its ruling on Friday in Asaba dismissed the petition on the ground of abandonment.
Justice Shittu Abubakar, said that the petitioner had failed to file the application for pre-hearing notices on time, as stipulated by law and therefore dismissed the case.
The tribunal also slammed a N20,000 fine against the petitioner.
Eselemo had filed a petition challenging the emergence of Gov. Uduaghan as the winner of the April 26 election, claiming that no election had taken place.
His counsel, Mr Rupert Irikefe, argued that the default in filing the processes on time was caused by the consistent evasion of the PDP to be served.
Irikefe argued against the request of the PDP for award of costs against his client, saying there was no ground for it in law.
Counsel to the PDP Jolone Ikomi had asked the tribunal to award his client N100, 000 costs for damages.
The tribunal, however, slammed a N20,000 fine against the petitioner after dismissing the case.
