The court reportedly granted Malami bail in an order dated December 23, 2025, but he has yet to be released from EFCC custody.
In a statement issued on Wednesday, Malami’s media aide, Bello Doka, described the continued detention as illegal and a clear violation of the court’s directive.
Doka accused the anti-graft agency of using the media to spread what he called false and misleading narratives, insisting that Malami voluntarily presented himself for investigation and had met the bail conditions earlier set by the EFCC.
“His continued detention at the EFCC facility is a breach of legal procedures and a blatant abuse of office,” Doka said.
He added that keeping Malami in custody after a court granted him bail amounts to a violation of his fundamental human rights and portrays the EFCC as an institution acting above the law.
The aide further claimed that officials of the commission allegedly turned away a court bailiff who came to serve the bail order, describing the action as a dangerous precedent for democracy.
He warned that disobedience to court orders by a constitutional body like the EFCC could undermine public confidence in the justice system.
Doka challenged the EFCC to formally arraign Malami in court if it has a case against him, instead of what he described as a media trial.
