Lagos Businesswoman Slams N10m Suit On Lufthansa Airlines
A Lagos businesswoman, Mrs. Folashade Okoya, has filed an application for final judgment before a federal high court against Lufthansa German Airlines. The plaintiff is demanding N10 million as compensation for the loss of her baggage.
In an affidavit sworn to by a legal practitioner, Mrs. Aluko Bolanle, and filed in the court, it was averred that on 18 January, 2011, Chief Folashade Okoya instituted this suit against Lufthansa German Airlines vide a writ and statement of claim.
Mrs. Aliko averred further that on 3 December, 2010 the airline conveyed the plaintiff and her husband, Chief Razak Akanni Okoya, from Frankfurt, Germany to Lagos and they arrived in Lagos the same day.
However, the plaintiff, on arrival in Lagos, Nigeria, recovered only four baggage out of the five baggage checked in at the departure point.
Immediately the plaintiff discovered that one of her baggage was missing, she reported to the airlines official at the airport and was asked to fill a property irregularity report with the baggage identification tag and list of the items in the missing baggage.
Five days after reporting the missing baggage, the plaintiff found that the airlines was not acting on the matter. After serving the defendant letters coupled with various visit to the defendants office, the plaintiff realised that the defendant was not making any efforts to recover the missing baggage.
The defendant was thereafter, duly served with court processes but refused to file any defence until the time stipulated to file defence expired.
The plaintiff urged the court to enter, in her favour, final judgment in the sum of N10 million, being special and general damages for the airline’s negligence in handling her baggage .
