Court Restrains Utomi’s Party

A Federal High Court sitting in Lagos State, South-West, Nigeria, has granted an order restraining the Independent National Electoral Commission, INEC, from recognising Prof. Pat Utomi’s party, the Social Democratic Mega Party, SDMP.

The order was part of reliefs sought by Mega Progressive People’s Party, MPPP, in a suit it filed against INEC before the court.

In the substantive suit, the MPPP is contending that it is unlawful for INEC to have any dealings with SDMP on the ground that the party shares the same slogan with it.

The court presided over by Justice C. M. A. Olatoregun Isola, granted in the interim, an interlocutory injunction restraining INEC or its agents from further monitoring, recognising or dealing with the SDMG pending the determination of the suit.

The court also restrained INEC from any other dealings with any person or group of persons parading themselves as Mega Party, other than the MPPP that is presently bearing that logo.

The case has been adjourned till 2 March, 2011 for the hearing of the substantive suit.
