Joined as co-defendants in the claim filed before the court by Barister Gani Bello are Chief Dayo Soremi and Independent National Electoral Commission (INEC).
The plaintiff averred that in a bid to resolve the crisis in the party in the state, it was agreed that the two major factions led by Senator Jubril Martins Kuye and the state governor, Otunba Gbanga Daniel, should jointly constitute a new executive committee.

Based on this agreement, Senator Osholake averred that though he was elected for the office of chairman by Kuye’s group, Chief Dayo Soremi still parades himself to the press, PDP and INEC as the nominee of the group.
The plaintiff also averredthat INEC has published the time table for april 2011 elections and as chairman he is the right person to organise election for the party aspirants. He feared unless Soremi is called to order, INEC may later declare all the primary elections of the primaries of the party null and void.
In view of this development, the plaintiff therefore urged the court not only to declare him as the nominee of the senator kuyeâ€
